Offer and validity

Where a product is on offer, the offer price and its period of validity will always be shown together with its essential characteristics.

In compliance with current regulations, OLATU S L provides information on all items for sale, their characteristics and prices. Nevertheless, OLATU S L reserves the right to withdraw, replace or change the products offered through its website simply by changing the website's content. Products offered through the website at any given time will therefore be governed by the General Terms and Conditions of Contracting in force in each case. OLATU S L will also have the right to cease offering access to those products at any time and without prior notice.

Essential characteristics of the products

The products offered in our online store include a photograph and their essential characteristics; this information is obtained from the manufacturer itself. The product characteristics identify the colours in which the product is available.

Guarantees

OLATU S L is liable for any lack of conformity of all products offered on the website for a period of three years from delivery.

In accordance with the General Law for the Protection of Consumers and Users, defects appearing during the first 2 years in new products are presumed to have existed at the time of delivery, unless the company can prove that the defect was caused by misuse.

OLATU S L provides an after-sales service for the period stated. The customer may contact the OLATU S L establishment, the after-sales service, by email at david@olatusurf.com or the points established by the provider itself. In the event of any doubt, the customer may contact customer service by telephone on 943493255 or by email at david@olatusurf.com.

Second-hand goods will be provided with a 12-month guarantee.

In the case of perishable products received in poor condition or after their expiry date, contact david@olatusurf.com. It is essential to follow the storage instructions specified on the packaging itself and to observe the expiry date, retaining proof of purchase in all cases.

Prices

All products state their retail price in euros and include Value Added Tax (VAT).

If any other tax applies, this will be stated (IGIC or IPSI).

Payment methods

The customer may pay the amount of the order using any of the following methods. The customer must indicate their choice during the purchasing process.

·         VISA or MASTERCARD credit card

All transactions involving the transmission of personal or banking data are carried out using a secure environment, a server based on standard SSL (Secure Sockets Layer) security technology. All information you send us travels over the network in encrypted form.

Credit card details are entered directly on the bank's website, at the POS terminal (the Bank's Point of Sale Terminal), and are not entered or recorded on any OLATU S L server.

When paying by VISA or MASTERCARD, you will always be asked for the following information: card number, expiry date and a Validation Code corresponding to the last three digits of the number printed in italics on the back of your VISA or MASTERCARD card, thereby providing greater guarantees regarding the security of the transaction.

This payment method is valid only on the website.

Where the amount of a purchase has been fraudulently or improperly charged using a payment card number, the cardholder may demand immediate cancellation of the charge. In that event, the corresponding debit and re-credit entries in the provider's and cardholder's accounts will be made as soon as possible.

However, if the purchase was in fact made by the cardholder and the demand for reimbursement was not the consequence of exercising the right of withdrawal or termination and the cardholder therefore improperly demanded cancellation of the corresponding charge, the cardholder will be obliged to compensate OLATU S L for the loss and damage caused as a result of that cancellation.

·         Bank transfer

When bank transfer is selected, you will receive an email containing OLATU S L's bank details together with your order confirmation.

It is very important that, when making the transfer, you state the order number and your first and last name in the reference and make the transfer within 3 days following the order confirmation date so that it can be validated.

If you wish, you may send us proof of the transfer by email to david@olatusurf.com. In any event, the order will not be considered effective until our administration department has received bank confirmation of the transfer.

Please remember that payment must be made in EUROS and that all possible exchange and bank fees are payable by you.

For bank transfers made from outside Spain, it is very important that when ordering the transfer you always instruct your bank to charge you the fees at origin, namely the bank fees and expenses charged by your institution. Otherwise, OLATU S L may suspend shipment of your order because it has not received the full amount.

Any exchange and bank fees are payable by the customer.

·         PayPal

PayPal allows payments to be sent over the Internet securely and conveniently. The PayPal network is based on the existing financial infrastructure of bank accounts and credit cards to create a global real-time payment solution. PayPal offers a service specially designed for those who are not satisfied with traditional payment mechanisms.

Further information is available from PayPal at http://www.paypal.com.

Complaint

If the user wishes to make a complaint, they must contact david@olatusurf.com or write to OLAGARAI TRASERA 2, 20180 OIARTZUN (GIPUZKOA). OLATU S L also has official complaint forms available to consumers and users.

Jurisdiction

OLATU S L also reserves the right to bring any civil or criminal proceedings it considers appropriate due to improper use of its website and content or failure to comply with these conditions.

The relationship between the user and the provider will be governed by the current regulations applicable in Spain. Should any dispute arise, the parties may submit their disputes to arbitration or resort to the ordinary courts in compliance with the applicable rules on jurisdiction and venue.
